Spare me the fancy-footwork: since the failure of a deterrent is proven by a body-count how would you PROVE that it had succeeded? A successful deterrent does not result in something tangible that can be counted. If I raise my hand to brain you but come to my senses BEFORE lowering the boom you survive. You are counted in assault statistics, but might have made the body-count had I NOT been deterred from delivering the fatal blow. Even having come this close to oblivion you yourself WOULD NOT REALIZE that a potential murder had been DETERRED. If I'm in the dock I myself am not going to testify that, yes, it was my intention to KILL you, but the image of the gas-chamber that popped into my mind scared me ENOUGH to hold back the fatal blow. Are you with me on this much? Now, some situations involve a cooler premeditation, [ that is, a situation other than, say, a robbery attempt that goes wrong, or a crime of passion,] in which the consequences of the act of murder are contemplated and dismissed as a risk thought to be worth taking, weighed against whatever GAIN such deliberations involve, psychological or material. Where that conclusion is reached NOTHING the state undertakes (absent the presence of an agent at the time and in the place,) will DETER the criminal from committing the crime. Not capital punishment; not life-without-parole, nothing. Sane or otherwise this bird wants to be disposed of, in my opinion, swiftly and certainly. I believe the uniform crime reports show that this KIND of killing is relatively rare, the kind that nothing can deter. To cite such a crime as evidence that the death penalty doesn't work to deter constitutes a non sequitor. Nothing works. In other instances it MAY work

Because we can't.  We can build prisons as fast as we can and fill them up as fast as we build them, but that will not solve the crime problem. It might if we didn't logjam the prisons with drug offenders. It would also work better if the sentencing were swifter and surere. Its been a few years, but IIRC the shrinks have shown that of the punishment traits of severity, surety, and swiftness, severity is the LEAST important when it comes to behavior modification.  Yet we emphasize it above the others.
